1. Acceptance of Terms

By accessing or using SoulEcho™, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the platform. You must be at least 18 years of age to create an account or use SoulEcho™. By using the service, you represent that you meet this age requirement.

2. Description of Service

SoulEcho™ is an AI-powered memorial platform. It allows users to upload data about deceased loved ones, including photos, voice recordings, text messages, and stories, and create AI-powered conversational memorials that reflect the personality, speech patterns, and memories of the person being remembered.

SoulEcho™ also allows living individuals to proactively record their own voice, answer questions about their life, and write messages for future milestones. This "plan ahead" feature lets someone shape how they will be remembered, with their family activating the memorial when the time comes.

The AI is not the actual person. It is an approximation based on uploaded data. Interactions with SoulEcho™ memorials should be understood as conversations with an AI that has been informed by the memories and data you provide, not as communication with the deceased.

3. User Accounts

You are responsible for maintaining the security of your account credentials. Each person may hold only one account. You agree to provide accurate and current information when creating your account and to update that information as needed. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, please contact us immediately.

4. Memorial Creation and Content

When creating a memorial, you must attest that you have the legal authority to do so. This typically means you are next-of-kin, an executor of the estate, or someone who was pre-authorized by the individual before their passing.

You are responsible for ensuring that the content you upload does not violate any applicable laws or the rights of any third party. SoulEcho™ does not verify the identity or authority of memorial creators beyond self-attestation.

You retain ownership of all content you upload to SoulEcho™. By uploading content, you grant SoulEcho™ a limited license to process, store, and use that content solely for the purpose of providing the memorial service to you and your designated family members. We will not use your content for any other purpose.

5. AI Disclaimer

The AI-powered memorial is not the deceased person. All responses generated by SoulEcho™ are approximations based on the data you have uploaded. The AI may produce responses that are inaccurate, incomplete, or entirely fabricated. While we work to make responses feel authentic, they are generated by a machine learning model and should be understood as such.

SoulEcho™ is not a substitute for professional grief counseling, therapy, or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or call the 988 Suicide and Crisis Lifeline.

Do not rely on AI-generated responses for medical, legal, financial, or safety decisions. The AI reflects patterns in uploaded data, not the actual knowledge or judgment of the person being remembered.

6. Ethical Use

SoulEcho™ is designed for respectful remembrance. You agree not to:

• Create memorials of living people without their explicit consent
• Use the platform to harass, defame, or impersonate any person
• Use voice clones or generated content for fraud, deception, or any unlawful purpose
• Upload content that is illegal, abusive, or violates the privacy rights of others

SoulEcho™ reserves the right to review and remove content that violates these guidelines, and to suspend or terminate accounts engaged in prohibited activity.

7. Payment and Subscriptions

SoulEcho™ offers a free tier with limitations as well as paid subscription plans. Paid subscriptions are billed monthly or as a one-time lifetime purchase, depending on the plan selected. All payments are processed securely by Stripe.

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not offer refunds for partial months of service.

The Lifetime tier is non-refundable after 30 days from the date of purchase. Within the first 30 days, you may request a full refund by contacting support.

8. Data and Privacy

Your use of SoulEcho™ is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You may request deletion of your account and all associated data at any time. Upon deletion, all memorial data, voice clones, conversation history, and AI-generated content will be permanently and irreversibly removed from our systems.

9. Intellectual Property

The SoulEcho™ name, logo, software, and all associated intellectual property are the property of CW Affiliate Investments LLC. You may not use our trademarks without prior written permission.

You retain full ownership of all content you upload to SoulEcho™. AI-generated conversation content (the responses produced during memorial interactions) is not exclusively owned by either party and may be used by you for personal purposes.

10. Limitation of Liability

SoulEcho™ is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate.

To the fullest extent permitted by law, CW Affiliate Investments LLC shall not be liable for any emotional distress arising from AI interactions, inaccuracies in AI-generated content, or any indirect, incidental, special, or consequential damages arising from your use of the platform.

Our maximum aggregate liability for any claims arising from or related to your use of SoulEcho™ shall not exceed the total fees you have paid to us in the twelve (12) months preceding the claim.

11. Termination

You may close your account at any time by contacting support or through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

Upon termination, whether initiated by you or by us, your data will be deleted within 30 days. If you wish to export your data before account closure, please do so before initiating termination.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email before the changes take effect. Your continued use of SoulEcho™ after updated Terms are posted constitutes your acceptance of those changes. We encourage you to review these Terms periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or your use of SoulEcho™ shall be resolved exclusively in the state or federal courts located in Outagamie County, Wisconsin.
